Buying Preconstruction Condos in Puerto Vallarta: A Due-Diligence Checklist
Updated: 2 hours ago
Preconstruction condos in Puerto Vallarta let buyers consider a property before it is finished. They also require evaluating a promise of future delivery. A rendering, launch discount or sales presentation cannot establish the condition of a completed building. Use a document checklist before paying a reservation or deposit.
Identify the seller and the land Ask your independent lawyer to verify the entity signing the contract, its authority and the legal relationship to the land. Request the relevant ownership documents and a review of liens or other limitations. Confirm the exact unit, parking and storage described in the offer. A development name can be shared across marketing material while the contracting company has a different legal identity.
Review permissions and project scope Ask which land-use and construction authorizations apply and whether they cover the project being sold. Compare approved documents with the advertised plans. Record unit areas, measurement method, finishes, equipment, terraces and amenities in the contract attachments. Clarify what can change and what remedy is available if it does.
Read the contract before comparing discounts Have an independent adviser review the full payment schedule, cancellation terms, delivery obligations, delay provisions and dispute process. Ask how buyer funds are received and documented. A large advance payment should not be evaluated only against the discount offered.
Mexico's NOM-247 establishes information and contract requirements for covered residential-property suppliers, including pre-sales. Ask your adviser to verify its application and, where required, the registered contract model. Registration does not replace an independent review of the actual transaction.
Distinguish unit delivery from a functioning development Ask when the unit can be occupied and when elevators, utilities, pools and other shared facilities will operate. Define inspection, defect reporting, handover documents and the treatment of unfinished common areas. Request the projected HOA budget and the assumptions behind it. A low promotional maintenance figure may not reflect full operation.
Investigate delivery experience Ask for completed projects by the same relevant team and entity, and seek owner references independently. Review what was delivered against original commitments. Construction photographs are useful, but they do not prove financing, permit validity or clear title. Track unresolved questions and assign each one to a document or professional who can answer it.
Preconstruction and foreclosure deals are different A listing described as a bank auction or “remate inmobiliario” may involve litigation rights or another arrangement rather than a finished home ready for transfer and possession. Have a specialist identify exactly what is being sold, its procedural status, occupation and costs. Do not treat it as a discounted version of a conventional purchase.
Choose the structure that fits your tolerance Compare a preconstruction proposal with a completed resale using total cost, delivery uncertainty and your need to move in or rent. Review Puerto Vallarta real estate and the closing-cost guide.
